1. Agreement and Acceptance of Terms

Welcome to FOOTBALLDAQ.online (referred to herein as "FOOTBALLDAQ", "the Platform", "we", "us", or "our"). By accessing our website, creating an account, subscribing to any payment tiers, or using any of our virtual trading features, you ("User", "Trader", or "you") agree to be bound by these Terms and Conditions of Service (the "Terms"). If you do not agree to all of these Terms, you are prohibited from using the Platform and must cease use immediately.

2. Game Rules, Virtual Currency, and Lack of Cash Value

FOOTBALLDAQ is a virtual fantasy football stock exchange simulation platform designed solely for entertainment and gamified amusement.

3. No Financial, Legal, or Investment Advice

The pricing, performance metrics, valuations, and dividend distributions of player and club "shares" are generated dynamically by mathematical algorithms based on live and historical football statistics. Nothing on the Platform constitutes professional financial advice, investment advice, tax advice, or legal advice. All trading is simulated, and you acknowledge that you cannot lose real money or make real money on the market itself.

4. Subscription Tiers, F-Funds Coin Purchases, and Billing Policies

Users may choose to license premium gameplay tiers or purchase additional virtual play-money via our storefront:

• Subscription Tiers (Daq+): We offer three paid tiers of membership: **Scout** (£4.99/mo), **Manager** (£9.99/mo), and **Executive** (£17.99/mo). Each tier unlocks specific limits for short selling, indices trading, ETF packages, competitor portfolio inspection, and bonus F£ allocations.
• Billing and Auto-Renewal: Subscribing to a Daq+ plan involves a recurring monthly charge to your chosen payment gateway. Your subscription will auto-renew every month unless you cancel it before your billing date.
• Coin Shop Bundles: Users may purchase F-Funds top-up packages (e.g., F£ 100,000 for £4.99, F£ 1,000,000 for £9.99, or F£ 10,000,000 for £14.99) to increase their virtual trading capacity.
• Refund Policy and Digital Items: All purchases of Daq+ subscriptions, virtual coin packages, and other digital items on the Platform are final and non-refundable. Since these are digital products delivered immediately upon transaction settlement, we do not offer refunds, cooling-off periods, pro-rated credits, or cash adjustments under any circumstances.

5. Payment Gateways and Namibia Merchant Processing

Transactions are processed securely through third-party payment gateways (e.g., PayPal, DPO Group, or Peach Payments). By executing a purchase, you agree to comply with the terms and privacy policy of the relevant payment processor.

For users and settlement under Namibian jurisdiction: Payment gateway payouts, if settled through PayPal, are cleared via the First National Bank of Namibia (FNB Namibia) PayPal withdrawal system in compliance with the Bank of Namibia exchange control regulations. Local credit/debit card transactions are processed securely via PCI-DSS compliant regional gateways.

6. Market Integrity and Abuse Prevention

To maintain a fair and competitive leaderboard environment, you agree not to engage in any market manipulation:

• Using automated bots, macro scripts, or scrapers to trade or extract data.
• Coordinating trades with other users to artificially manipulate the price of players (e.g. pump and dump schemes).
• Exploiting software vulnerabilities, logic glitches, or latency loops to accumulate unauthorized F-Funds.

Violation of this policy will result in the immediate and permanent locking of your account, forfeiture of all virtual portfolios, and potential IP bans.

7. Data Accuracy and Platform Reliability

We retrieve player data, club results, and manager updates from public sports APIs and simulated sports modules. We do not guarantee the completeness, accuracy, or real-time delivery of this data. Platform downtime, API service disruptions, or price fluctuations resulting from statistical errors are not grounds for claims or refunds of real money.

8. Third-Party Affiliate Links and External Purchases

The Platform features affiliate advertisements, sponsor showcases, and promotional links for third-party products (such as football kits, cleats, and equipment). Some of these links are affiliate links, meaning we may earn a referral commission if you make a purchase after clicking. All external transactions and purchases are conducted directly on the third-party partner's website. FOOTBALLDAQ has no control over, does not guarantee, and assumes no responsibility or liability for third-party websites, their products, pricing, delivery, returns, or support.Any issues or disputes regarding affiliate purchases must be resolved directly with the merchant where the purchase was made.

9. Limitation of Liability and Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOOTBALLDAQ.ONLINE, ITS FOUNDERS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, COMPUTER FAILURE, OR SYSTEM OUTAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE PLATFORM. YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS FOOTBALLDAQ FROM ANY CLAIMS, LIABILITIES, OR COSTS ARISING FROM YOUR BREACH OF THESE TERMS.

10. Governing Law

These Terms and any dispute arising out of or related to your use of the Platform shall be governed by, interpreted, and enforced in accordance with the laws of the Republic of Namibia, without regard to conflicts of law principles.
